Terms of Use

1. Introduction

Welcome to NIAMO ("we", "our", "us"). NIAMO is a relationship companion application designed to help couples connect, share memories, and celebrate their relationship. These Terms of Use ("Terms") govern your access to and use of the NIAMO mobile and web application (the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use NIAMO. These Terms constitute a legally binding agreement between you and NIAMO, governed by the laws of the Republic of South Africa.

2. Eligibility

You must be at least 18 years of age to use NIAMO. By registering, you confirm that you are 18 or older and legally capable of entering into a binding agreement under South African law.

If you are accessing the Service on behalf of another person, you confirm that you have their consent to do so.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@niamoapp.com if you become aware of any unauthorised use of your account.

You may only create one account per person. Creating multiple accounts to circumvent restrictions is prohibited.

4. Partner Linking

NIAMO allows you to link your account with one partner. Invite codes are single-use and tied to a specific email address. You may not share, sell, or transfer invite codes to third parties.

You may unlink your partner at any time from within the app. Upon unlinking, your partner will lose access to your shared space, though previously created content remains associated with the couple profile.

5. Acceptable Use

You agree not to use NIAMO to:

  • Upload or share content that is unlawful, abusive, threatening, defamatory, or obscene
  • Harass, stalk, or intimidate any person
  • Infringe the intellectual property rights of others
  • Attempt to gain unauthorised access to other users' accounts or data
  • Use the Service for any commercial purpose without our prior written consent
  • Introduce malicious software or interfere with the integrity of the Service
  • Violate any applicable South African or international law or regulation

6. Content You Upload

You retain ownership of all content you upload to NIAMO (photos, notes, moments, etc.). By uploading content, you grant NIAMO a non-exclusive, royalty-free licence to store, display, and process that content solely for the purpose of providing the Service to you and your linked partner.

You are solely responsible for the content you post. We reserve the right to remove content that violates these Terms.

7. Subscription Plans

NIAMO offers a Free plan and a Premium plan. Features available on each plan are described in the app and may change over time. We will provide reasonable notice of any material changes to plan features.

Premium subscriptions are billed as indicated at the time of purchase. All prices are in South African Rand (ZAR) unless otherwise stated. Subscription fees are non-refundable except as required by the Consumer Protection Act, 68 of 2008 ("CPA").

8. Intellectual Property

All intellectual property in the NIAMO Service, including its design, software, trademarks, and content created by us, belongs to NIAMO or its licensors. Nothing in these Terms transfers any IP rights to you.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by South African law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, NIAMO shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the CPA or any other applicable South African legislation.

11. Termination

You may delete your account at any time from within the app. We may suspend or terminate your account if you breach these Terms, without prior notice where the breach is serious.

Upon termination, your access to the Service will cease. We may retain certain data as required by law or legitimate business purposes, as described in our Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall first be referred to informal negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the South Gauteng High Court, Johannesburg, or the relevant Magistrate's Court for smaller claims.

You may also lodge a complaint with the National Consumer Commission (NCC) or the relevant ombud if you believe your consumer rights have been infringed.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
